These Terms of Service govern your access to and use of Sekond, an AI‑powered platform for creating spoken audio content. Please read them carefully before using the Platform.
1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of Sekond ("the Platform," "we," "us," or "our"), an AI-powered platform for creating spoken audio content, accessible at sekond.io. By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
We reserve the right to update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
2. Eligibility
To use Sekond, you must:
- Be at least 18 years old or the age of legal majority in your jurisdiction.
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the Platform under applicable law.
- Provide accurate, current, and complete registration information.
If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Account Registration and Security
3.1 Account Creation
You must create an account to use the Platform. You agree to provide accurate and complete information during registration and to keep this information up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at no-reply@sekond.io if you suspect unauthorized access to your account.
3.3 Account Termination
You may delete your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on the severity of the violation.
4. Platform Description
Sekond is an AI-powered platform that enables users to:
- Create audiobooks by uploading manuscripts and selecting AI narrator voices.
- Generate podcasts by writing or uploading essays and casting AI speakers to produce multi-voice conversational dialogue.
- Build knowledge bases by uploading documents, media files, URLs, and notes to ground AI-generated content.
- Generate spoken dialogue from written text using large language models (LLMs).
- Produce synthetic audio using text-to-speech (TTS) technology with selectable and customizable AI voices.
- Transcribe audio and video using speech-to-text technology with speaker diarization.
- Download outputs in multiple formats including plain text, SRT, WebVTT, Markdown, and JSON.
5. User Content
5.1 Definition
"User Content" means all materials you upload, submit, create, or otherwise provide through the Platform, including but not limited to: manuscripts, essays, text, documents (.txt, .md, .docx, .pdf, .rtf, .html), audio files (.mp3, .wav, .m4a), video files (.mp4, .mov, .webm, .avi), URLs, notes, and any other content provided to the Platform.
5.2 Ownership
You retain all ownership rights in your User Content. Sekond does not claim ownership of any content you upload or create on the Platform.
5.3 License Grant
By uploading or submitting User Content, you grant Sekond a non-exclusive, worldwide, royalty-free, sublicensable license to use, process, store, reproduce, and display your User Content solely for the purpose of operating, maintaining, and providing the Platform's services to you. This includes: parsing and extracting text from uploaded documents; indexing content for knowledge base retrieval and vector search; processing content through AI models to generate essays, dialogue, and audio; transcribing audio and video files; storing your content for persistence across sessions. This license terminates when you delete the applicable content or your account, subject to reasonable backup and archival periods not to exceed 90 days.
5.4 Your Representations
You represent and warrant that: you own or have all necessary rights, licenses, and permissions to upload and use the User Content; your User Content does not infringe or violate any third party's intellectual property rights, privacy rights, or any applicable law; any manuscripts, essays, or texts you upload are either your original work or you have authorization to use them; any audio or video files you upload do not contain content you are not authorized to process or reproduce.
6. AI-Generated Content
6.1 Nature of AI-Generated Content
The Platform uses large language models (LLMs) and text-to-speech (TTS) technology to generate content including essays, multi-speaker dialogue, and synthetic audio. AI-generated content is produced algorithmically and may not always be accurate, complete, or free of errors. AI-generated dialogue is a creative interpretation of your source material and may not perfectly reflect the intent or meaning of the original text. AI-generated audio uses synthetic voices that simulate human speech but are not recordings of real individuals.
6.2 Ownership of AI-Generated Outputs
Subject to your compliance with these Terms and applicable law, you own the outputs generated by the Platform from your User Content, including generated essays, dialogue transcripts, and audio files. Ownership is subject to the underlying rights in your input content. You are solely responsible for ensuring your use of AI-generated outputs complies with applicable laws. Sekond makes no representations regarding the protectability of AI-generated content under intellectual property laws, which may vary by jurisdiction.
6.3 Dysfluency Processing
The Platform applies dysfluency patterns (filler words, hesitations, and natural speech patterns) to generated audio based on per-speaker behavioral profiles. These are applied automatically during audio generation to enhance naturalness.
7. Synthetic Voice and Audio
7.1 AI Voices
AI voices are synthetic and do not represent any real individual unless explicitly provided as a voice clone. The quality, tone, and characteristics of AI voices may vary. AI voices are provided by third-party services and are subject to those providers' terms and limitations.
7.2 Voice Cloning
If the Platform offers voice cloning capabilities, you represent and warrant that: you have obtained explicit, informed consent from any individual whose voice you clone or replicate; you will not use voice cloning to impersonate, deceive, defraud, or mislead others; you will not clone the voice of any individual without their knowledge and written permission; you comply with all applicable laws regarding synthetic media, deepfakes, and voice reproduction in your jurisdiction. Violation of these provisions constitutes grounds for immediate account termination and may be reported to relevant authorities.
7.3 Audio Output
Generated audio files are provided for your personal or authorized commercial use. You are responsible for any downstream use of audio generated on the Platform, including ensuring it complies with applicable laws regarding synthetic or AI-generated media disclosure requirements.
8. Prohibited Uses
8.1 Illegal or Harmful Activity
Violating any applicable law; generating content that promotes violence, terrorism, hate speech, discrimination, or illegal activity; creating content that exploits, harms, or endangers minors.
8.2 Fraud and Deception
Impersonating any person or entity; creating synthetic audio intended to deceive listeners; generating disinformation; using voice cloning without consent.
8.3 Intellectual Property Violations
Uploading content you don't have rights to; reproducing copyrighted material without licensing; violating trade secrets or confidential obligations.
8.4 Platform Abuse
Reverse-engineering the Platform or AI models; circumventing access controls; using unauthorized bots or scripts; disrupting infrastructure; reselling services without authorization.
9. Intellectual Property
9.1 Platform IP
The Platform, including its design, features, code, AI models, user interface, trademarks, and documentation, is owned by Sekond and protected by intellectual property laws.
9.2 Feedback
If you provide feedback, suggestions, or ideas about the Platform, you grant Sekond a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without obligation to you.
10. Third-Party Services
The Platform integrates with third-party services for text-to-speech (e.g., ElevenLabs), large language models, and speech-to-text. Your use may be subject to those providers' terms and policies. Sekond is not responsible for the availability, accuracy, or policies of third-party services.
11. Fees and Payment
Pricing details and feature availability are described on our pricing page and may change with 30 days' notice. Paid plan fees are billed in advance on a recurring basis. Refunds are handled case-by-case via no-reply@sekond.io.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. Sekond does not warrant that AI-generated content will be accurate, complete, or suitable for any particular purpose; that generated audio will meet specific quality standards; that transcription will be error-free; or that the Platform will be uninterrupted. You are solely responsible for reviewing all AI-generated content before use.
13. Limitation of Liability
SEKOND'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER. SEKOND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
14. Indemnification
You agree to indemnify and hold harmless Sekond from claims arising out of your use of the Platform, your User Content, your violation of these Terms or third-party rights, your use of voice cloning features, and any downstream use of AI-generated content.
15. DMCA and Copyright Complaints
Copyright complaints may be submitted to no-reply@sekond.io with required information including description of the copyrighted work, location of infringing material, contact information, good faith statement, statement under penalty of perjury, and signature.
16. Governing Law and Dispute Resolution
Governed by the laws of the Republic of the Philippines. Disputes resolved through good-faith negotiation, then binding arbitration in Metro Manila, Philippines. Class action waiver applies.
